CALIFORNIA RELEASE OF LIABILITY, ASSUMPTION OF RISK,
WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT
Imagination Indoor Playground
As consideration for being permitted to enter Imagination Indoor Playground, use the facility, play areas, equipment,
and/or participate in any activities, parties, programs, or events ("Activities"), the undersigned Parent/Guardian agrees on behalf of themselves and the minor participants) as follows:
1. ASSUMPTION OF RISK
Participation involves inherent risks including slips, falls, collisions, use of play equipment, exposure to illness, serious
injury, paralysis, or death. I knowingly and luntarily assume al risks, including those arising from the ordinary
negligence of Imagination Indoor Playground to the fullest extent permitted by California law.
2. RELEASE & WAIVER OF LIABILITY
I hereby release, waive, and discharge Imagination Indoor Playground, its owners, officers, employees, agents,
affiliates, landlords, and representatives from any and al claims, demands, damages, injuries, losses, or liabilities
arising from participation, except for gross negligence or wilful misconduct.
3. INDEMNIFICATION
I agree to defend, indemnity, and hold harmless the Released Parties from any and al claims, damages, losses,
costs, or expenses (including attorney's fees) arising out of or related to participation by myself or the minor
participants) in my care.
4. CALIFORNIA CIVIL CODE §1542 WAIVER
I expressly waive California Civil Code §1542, which provides that a general release does not extend to claims which
the releasing party does not know or suspect to exist. I acknowledge that I may later discover claims or facts different
from those now known or believed to be true, and I fuly release al such claims.
5. ARBITRATION & JURY TRIAL WAIVER
Any dispute or claim arising out of or relating to this Agreement shall be resolved exclusively by binding arbitration
within 25 miles of the facility, in accordance with the rules of the American Arbitration Association. I knowingly waive
my right to a jury trial.
MEDIA RELEASE
I grant permission for Imagination Indoor Playground to use photographs or video recordings of myself and/or the
minor participant(s) for marketing and promotional purposes without compensation.
